FAST SCREENPLAY v2 TERMS & CONDITIONS (v1.1)
Effective Date: December 6, 2025
These Terms & Conditions ("Terms") govern your access to and use of FAST Screenplay v2 ("FAST," "Service," or "Platform"), operated by Planet B Studios, Inc., a California C-Corporation ("Company," "we," "us," or "our").
By accessing or using FAST Screenplay v2, you agree to these Terms. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 18 years old to use FAST Screenplay v2.
Users under 18 may only use the Service with the verifiable consent of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements and that all information you provide is accurate and complete.
2. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us promptly of any unauthorized access or suspected security breach. We are not responsible for losses resulting from unauthorized access caused by your failure to safeguard your credentials.
3. Ownership of Creative Content
You retain full ownership of all creative content you create, upload, or store using FAST Screenplay v2, including but not limited to:
- Journals
- Notes
- Drafts
- Scripts
- Companion conversations
We claim no ownership rights in your creative content.
4. Limited License to Operate the Service
You grant the Company a limited, non-exclusive, non-transferable, revocable license to process your content solely as necessary to provide, maintain, and improve the Service, in accordance with these Terms and our Privacy Policy.
This license does not permit the Company to:
- Train machine learning or AI models on your creative content
- Read or review plaintext creative content
- Sell, license, or disclose your creative content
5. AI & Assistive Tools Disclaimer
FAST Companion and other AI-assisted features are provided for informational and creative assistance purposes only.
They do not constitute professional, legal, medical, financial, or other regulated advice and are not a substitute for human judgment.
You acknowledge that AI-generated outputs may be incomplete, inaccurate, or biased, and you assume full responsibility for how such outputs are interpreted or used.
6. Acceptable Use
You agree not to use FAST Screenplay v2 to:
- Store, transmit, or generate content that is illegal to possess
- Facilitate, plan, or coordinate real-world criminal activity
- Infringe the intellectual property or privacy rights of others
- Circumvent, probe, or interfere with security or privacy safeguards
- Harass, threaten, or abuse other users
Creative, fictional, artistic, or exploratory depictions of illegal, disturbing, or controversial subject matter are expressly permitted, provided such content does not itself constitute illegal material or real-world facilitation.
7. Monitoring, Enforcement & Suspension
FAST Screenplay v2 is designed to minimize access to user content and does not routinely monitor or review creative content.
However, the Company reserves the right to:
- Investigate credible reports of misuse or legal violations
- Temporarily suspend accounts pending review
- Request reasonable assurances of lawful use
- Terminate accounts for violations of these Terms or applicable law
Where feasible and lawful, users will be permitted to export their data prior to termination.
8. Payments, Subscriptions & Refunds
FAST Screenplay v2 may offer free tiers, paid subscriptions, and lifetime licenses.
Payments are processed by third-party payment processors, including Stripe. The Company does not store payment card information.
Unless otherwise stated, the Company offers a 30-day refund policy, subject to reasonable use limitations and abuse prevention.
9. Third-Party Services
FAST Screenplay v2 may integrate or interoperate with third-party services, including but not limited to:
- Payment processors
- Cloud hosting providers
- Optional AI or processing services
The Company is not responsible for the availability, security, or performance of third-party services. Your use of such services is governed by their respective terms and policies.
10. Data Export & Deletion
You may export your data while your account is active, subject to technical limitations.
We encourage users to maintain their own backups of important work, as no software system can guarantee permanent storage or recovery.
Upon account deletion:
- Active account data is deleted typically within a reasonable period following deletion
- Certain data may be anonymized and retained for analytics, system integrity, or legal compliance
Deletion timelines may vary based on technical, operational, or legal requirements.
11. Disclaimer of Warranties
FAST Screenplay v2 is provided "as is" and "as available."
To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
12. Limitation of Liability
To the maximum extent permitted by law:
- The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- The Company's total liability arising out of or relating to the Service shall not exceed the amount paid by you to FAST Screenplay v2 in the twelve (12) months preceding the claim
13. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your content
- Your violation of these Terms or applicable law
14. Force Majeure
The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, power or internet outages, or failures of third-party infrastructure.
15. Assignment
You may not assign or transfer these Terms or your account without the Company's prior written consent.
The Company may assign or transfer these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
16. Modification of Terms
The Company may modify these Terms from time to time.
Material changes will be communicated via reasonable means, such as email or in-app notice. Continued use of the Service after the effective date of changes constitutes acceptance of the modified Terms.
17. Arbitration & Class Action Waiver
PLEASE READ CAREFULLY.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association, conducted in Los Angeles, California, unless otherwise required by law.
You waive the right to participate in class actions, class arbitrations, or representative proceedings.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior or contemporaneous agreements, communications, or understandings.
20. Severability & Survival
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
Sections relating to ownership, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law shall survive termination.
